Crashalytics Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Crashalytics platform ("Platform"), owned and operated by Furiousa Solutions, a company registered in Nairobi, Kenya ("Furiousa Solutions," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations in Kenya. If you do not agree to these Terms, you may not use the Platform.

IMPORTANT: Furiousa Solutions is not a gambling platform or operator. We provide data-driven analytical tools designed to assist users in making informed decisions related to gambling activities. The ultimate responsibility for any gambling actions and their outcomes rests solely with the user.

1. Acceptance of Terms

By creating an account, purchasing tokens, or using any services provided by Crashalytics, you confirm that:

• You have read, understood, and agree to be bound by these Terms.
• You are of legal age to enter into a binding contract and to engage in gambling activities in your specific jurisdiction.
• You will comply with all applicable laws and regulations regarding your use of the Platform and any related gambling activities.

2. Services Provided

Crashalytics offers a suite of six (6) data-driven tools aimed at improving gambling profitability and reducing losses through smarter decisions, primarily for crash games and betting. These tools include:

• Hedge Bets Calculator
• Crash Game Strategy Calculator
• Advanced Crash Game Strategy Simulator
• Crash Game Multiplier Analyzer
• Bet Journal
• Matchup Researcher

These tools are provided for analytical and informational purposes only. They are designed to help users in their decision-making processes but are separate from any actual gambling platform or activity.

3. Token-Based Payment System and No Refunds

• Token Purchase: Access to Crashalytics' tools is granted through the purchase of "Tokens." These Tokens are debited from your account as you use the Platform's tools.
• Payment Processing: All payments for Tokens are securely processed via Paystack, a third-party payment gateway. We do not store your sensitive payment card details.
• No Refunds: All purchases of Tokens are final and non-refundable. By purchasing Tokens, you acknowledge and agree that no refunds will be issued under any circumstances, including but not limited to dissatisfaction with tool performance, changes in personal circumstances, or perceived lack of profitability from gambling activities.
• Unfulfilled Token Purchases: The only liability we accept responsibility for relates to payments made for Tokens that are unfulfilled (i.e., you paid, but the corresponding Tokens were not credited to your account). In such verified cases, we will ensure the correct number of Tokens are credited to your account.
• Token Expiration: Tokens do not expire, unless otherwise explicitly stated and communicated by us at our sole discretion through an an update to these Terms.

4. User Accounts and Data

• External Authentication: Crashalytics utilizes an external authentication provider, Clerk. When you create an account, Clerk handles your login credentials.
• No Password Storage: We do not store any information related to your passwords. Your passwords are managed entirely by our external authentication provider.
• Information Collected: For service provision, we collect your email address (for account management and communication) and a username (for platform interaction). We do not collect any other personal data or technical data, including IP addresses, browser information, or device details.
• Account Deletion: You may delete your Crashalytics account at any time. Upon account deletion, all user data associated with your account that we store (email and username) will be deleted with immediate effect. Please note that once deleted, your account and data cannot be recovered.

5. Disclaimers and Limitation of Liability

• No Guarantee of Profitability: Furiousa Solutions explicitly states that the use of Crashalytics tools and the results or insights generated by them do not guarantee profitability, winnings, or reduction of losses in gambling activities. Profitability and outcomes are influenced by numerous unpredictable factors including, but not limited to, individual usage and implementation of strategies, inherent risks of gambling, external market conditions, and pure chance, all of which are entirely outside of our control.
• Not Gambling Advice: The information and tools provided on Crashalytics are for educational and analytical purposes only and should not be construed as financial, investment, or gambling advice. You are solely responsible for all your gambling decisions and any financial gains or losses that may result.
• "As Is" Service: The Platform and its tools are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted, secure, or error-free service.
• Limitation of Liability: To the maximum extent permitted by Kenyan law, Furiousa Solutions, its affiliates, directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform and its tools; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
• Maximum Liability: Our total liability for any claim arising out of or relating to these Terms or the Platform shall be limited to the amount you have paid to Furiousa Solutions for Tokens in the twelve (12) months preceding the event giving rise to the claim.

6. User Conduct and Prohibited Activities

You agree not to use the Platform for any purpose that is unlawful or prohibited by these Terms. Prohibited activities include, but are not limited to:

• Any form of platform misuse, including attempting to gain unauthorized access to the Platform or other user accounts.
• Interfering with the proper working of the Platform or attempting to bypass any security measures.
• Using automated scripts or bots to access, scrape, or interact with the Platform or its tools.
• Uploading or transmitting any viruses, malicious code, or other harmful components.
• Engaging in any activity that violates any applicable local, national, or international law or regulation.
• Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

Violation of this section may result in immediate termination of your account without refund for any unused Tokens.

7. Intellectual Property

All content, features, and functionality on the Crashalytics Platform, including the tools, software, design, text, graphics, and underlying code, are and will remain the exclusive property of Furiousa Solutions and its licensors. These Terms do not grant you any right to use our trademarks, logos, or any other intellectual property.

8. Maintenance and Service Availability

We perform regular maintenance checks and updates to the Platform to ensure optimal performance and to introduce new features. These maintenance checks may, at times, affect the availability or functionality of our services. While we strive to minimize disruption, we do not guarantee uninterrupted access to the Platform.

9. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform, which cannot be resolved amicably, shall be submitted to the competent courts in Nairobi, Kenya.
